1. Acceptance of Terms
By accessing or using genericspecialty.com (the "Site"), you agree to be bound by these Terms of Use ("Terms"). If you do not agree to these Terms, you must not use the Site. These Terms apply to all visitors, users, and customers of the Site.
Generic Specialty Group ("GSG", "we", "us", or "our") reserves the right to amend these Terms at any time. The date of last update is shown above. Continued use of the Site following any update constitutes acceptance of the revised Terms.
2. Services & Scope
GSG operates as an independent pharmaceutical API sourcing intermediary. We do not manufacture, compound, or formulate any pharmaceutical products or active pharmaceutical ingredients (APIs). All services consist of:
- Identification and introduction of GMP-qualified API manufacturers for specific molecules and markets
- Provision of regulatory documentation including Certificates of Analysis (CoA), Drug Master File (DMF) reference letters, impurity profiles, and stability data on behalf of or in coordination with manufacturers
- Commercial facilitation (pricing, MOQ, lead time) between buyers and GMP-qualified manufacturers
- Logistics coordination and customs documentation support
GSG acts as a broker and facilitator. All commercial contracts for the supply of APIs are entered into between the buyer and the manufacturer directly. GSG is not a party to any supply contract unless explicitly stated in writing.
3. B2B Use Only
This Site and all services are available exclusively to business entities operating in the pharmaceutical industry, including but not limited to: generic pharmaceutical manufacturers, specialty and branded pharmaceutical companies, contract manufacturing organizations (CMOs and CDMOs), compounding pharmacies, and pharmaceutical distributors.
Use of this Site by individual consumers, patients, or for any non-commercial or personal purpose is strictly prohibited. By using the Site or submitting an inquiry, you represent and warrant that you are acting on behalf of a qualified business entity.
4. Quotations & Pricing
All quotations provided by GSG (including Complete Source Quotes) are:
- Indicative only unless confirmed in a signed purchase order or written commercial agreement
- Valid for the period specified in the quotation, or 30 days from issuance if no period is stated
- Subject to manufacturer availability, currency fluctuations, and regulatory changes
- Exclusive of applicable taxes, duties, customs charges, and freight unless expressly stated otherwise
GSG makes reasonable efforts to ensure pricing and specifications are accurate at the time of quotation. However, final pricing and specifications are subject to the manufacturer's confirmation and applicable commercial agreements.
5. Regulatory & Compliance
All regulatory documentation provided by GSG (CoA, DMF reference letters, impurity profiles, stability data, GMP certificates) is sourced from manufacturers and is provided in good faith. GSG does not independently verify or certify the accuracy of manufacturer-supplied documentation.
It is the sole responsibility of the buyer to verify all regulatory documentation, conduct appropriate supplier qualification, and ensure compliance with all applicable laws, regulations, and guidelines in their target market (including but not limited to FDA, Health Canada, EMA, TGA, and PMDA requirements).
GSG does not provide regulatory affairs advice, legal advice, or compliance consulting services. Nothing on this Site constitutes regulatory guidance.
NDMA / Nitrosamine Notice: Nitrosamine risk assessment results and NDMA test data provided in quotations are sourced from manufacturers and are provided for reference only. Buyers are responsible for independently verifying nitrosamine compliance under applicable FDA/EMA guidance prior to any regulatory submission or commercial use.
6. Intellectual Property
All content on this Site — including text, design, graphics, logos, and code — is the property of Generic Specialty Group or its licensors and is protected under applicable Canadian and international intellectual property laws.
You may not reproduce, distribute, modify, or create derivative works from any Site content without prior written consent from GSG. The GSG logo and "Complete Source Quote" are trademarks of Generic Specialty Group.
7. Disclaimer of Warranties
This Site and all content are provided "as is" and "as available" without warranties of any kind, whether express or implied. To the fullest extent permitted by applicable law, GSG disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
GSG does not warrant that the Site will be uninterrupted, error-free, or free of viruses or other harmful components. Regulatory and technical information on this Site may not reflect the most current developments and should be independently verified.
8. Limitation of Liability
To the maximum extent permitted by applicable law, GSG and its officers, directors, employees, agents, and affiliates (including Burrard Pharma) shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from or related to:
- Use of or inability to use this Site or its content
- Reliance on any quotation, specification, or regulatory documentation provided
- Any transaction or commercial relationship with a manufacturer introduced by GSG
- Regulatory non-compliance arising from use of sourced APIs
In no event shall GSG's total liability to any party exceed the fees actually paid by that party to GSG in the twelve (12) months preceding the claim, or CAD $500, whichever is greater.
9. Confidentiality
Information submitted through inquiry forms, email, or the client portal is treated as confidential and is not shared with third parties except as necessary to fulfill the requested service (i.e., communicating with potential API manufacturers). Please review our Privacy Policy for full details on how we collect, use, and protect personal and business information.
GSG will not disclose the identity of inquiring parties to manufacturers without prior consent, unless required to complete a quote or facilitate a sample/commercial transaction.
10. Third-Party Links
This Site may contain links to third-party websites, including burrardpharma.com and external regulatory bodies. These links are provided for convenience only. GSG does not endorse, control, or take responsibility for the content, accuracy, or practices of any third-party website.
11. Governing Law
These Terms are governed by and construed in accordance with the laws of the Province of British Columbia, Canada, without regard to conflict of law principles. Any disputes arising from these Terms or use of this Site shall be subject to the exclusive jurisdiction of the courts of British Columbia.
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
